I. General Terms and Conditions
§ 1 Basic provisions
(1) The following terms and conditions apply to all contracts that you conclude with us as the provider (Beyza Özler, Wild Heart Free Soul) via the website www.wildheartfreesoul.com . Unless otherwise agreed, the inclusion of any applicable terms and conditions is hereby excluded.
(2) A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or independent professional activity.
§ 2 Conclusion of the contract
(1) The subject of the contract is the sale of goods, digital content and vouchers.
(2) By placing the respective product on our website, we make you a binding offer to conclude a contract on the terms and conditions specified in the item description via the online shopping cart system.
(3) The contract is concluded via the online shopping cart system as follows:
The goods intended for purchase are placed in the "Shopping Cart." You can access the "Shopping Cart" using the corresponding button in the navigation bar and make changes there at any time. After accessing the "Checkout" page and entering your personal information as well as the payment and shipping terms, the order details will be displayed as an order overview. Before submitting the order, you have the opportunity to review all information, change it (also using the "Back" function of your internet browser), or cancel the purchase. By submitting the order using the "Buy" button, you declare your legally binding acceptance of the offer, thereby concluding the contract.
(4) The processing of orders and the transmission of all information required in connection with the conclusion of the contract are partially automated via email. You must therefore ensure that the email address you have provided us with is correct and that receipt of emails is not technically prevented by spam filters or other settings.
§ 3 Special information on digital content and vouchers
(1) Digital content is data that is not stored on a physical storage medium and is created and provided digitally. The purchase of digital content entitles the user to use it within the scope of the respective license terms.
(2) Electronic vouchers will be sent to you via email in the form of a code that can be redeemed in the online shop. Cash payment is excluded.
§ 4 Methods of payment
The available payment methods are listed under a correspondingly labeled button on our website. Processing can also be carried out through payment service providers (e.g., PayPal, Klarna, Stripe). Their terms and conditions apply. If a credit check is a prerequisite for certain payment methods, you agree to their implementation.
§ 5 Retention of title
The goods remain our property until full payment has been made.
§ 6 Delivery, export and shipping costs
(1) Delivery will be made within the delivery times specified on the website. Shipping costs and terms are listed on a separate page and are available during the ordering process.
(2) For deliveries to non-EU countries (e.g., Switzerland, UK, USA), a legally required customs export declaration is required for goods valued at €1,000 or more, which we will handle for you. The resulting additional costs of €55 will be invoiced separately.
(3) In the case of self-collection, we will inform you by email about the availability of the goods and the collection options.
§ 7 Warranty and Liability
(1) The statutory liability for defects applies.
(2) For used goods, the warranty period shall be one year from delivery. Excluded from this are claims for damages in cases of gross negligence, intent, or injury to life, body, or health.
§ 8 Choice of law, place of jurisdiction
(1) The law of the Federal Republic of Germany shall apply. For consumers, this choice of law applies only to the extent that mandatory consumer protection provisions of the country of residence do not conflict with it.
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
